Context menu missing from right-click on folder window instead of folder icon

If you go into a folder and right-click on an empty area of the folder-listing window, the app does not appear in the context menu. It only appears when you go a level up and right-click the icon of the folder. Not exactly a wail-and-pull-my-hair-out problem, but it's still kind of weird.
