Scrolling when menu panel is open!

It would be great if when the menu is open then only the menu itself is scroll-able but the page does not scroll. i have come across issues:

1. menu is bigger then the page content and screen size- after menu panel is opened and closed then the page is scroll-able down where there is no content.
2. page is bigger then screen and menu - when menu is open i am able to scroll down like an empty menu continues.
3. large page and looking at the bottom of the page - when i push the menu button an empty panel shows because the menu is at the top of the page but i would like it fixed to the devices side.

2. This is downside of page and panel scroll together.
3. When the panel content is not in view the framework will scroll to the top of the page. Click "Default panel" button halfway this page http://jquerymobile.com/test/docs/panels/index.html for example.
