Question regarding the CoC

Hello, I read the CoC and am a bit confused. The CoC encourages contributors and members to "demonstrate empathy and kindness" and to "be respectful". The CoC also discourages "conduct which could reasonably be considered inappropriate in a professional setting" and "public or private harassment".
Would it be considered against the CoC to actually deploy the malware? I say this because to actually use the malware without someone else's consent would very obviously be unkind, disrespectful of the victim, probably harassing, and obviously extremely unprofessional.
This is the first time I've seen malware with a CoC, so its a rather new experience for me.
