There are several sub-optimal things around viaIR:

The latest version now has a better behavior by default. We should investigate how to rely on that, since it's version-dependent.
We need to review how we are using viaIR in our tests (see also Use default optimizerSteps when using viaIR edr#443)
We should have a better explanation about all of this in our tests. This discussion is interesting in that respect.
