Code of Conduct Terms of Service

Due the ever-present abuse of the platform and its users by malicious actors, hicetnunc.xyz has been restricting a number of accounts, both reactively and proactively for any actions that infringes our terms of services (read community guidelines WG 5.2). Restricted addresses get their OBJKTs frozen, not being able to trade through our UI, being only able to burn them through our UI. To participate in the discussion such can be done through our Discord Server or through hicetnunc2000@protonmail.com. Decentralised means of moderation/communication along peers is also being researched.

An account will be subject to restriction if:

•   Copyminting: minting another artist(s) work without their consent. This will result in an immediate and irrevocable restriction.
  

•   Wash Trading: market manipulation through the buying of own OBJKTs directly or indirectly through a network of addresses. This will result in an immediate and irrevocable restriction.
  

•   Explicit, sensitive, offensive or hate discourses which doesn't present artistic intents: this will result in an immediate and irrevocable restriction.
  

•   Funding from confirmed restricted accounts for the above reasons: This will result in an immediate and irrevocable restriction.
  

•   Funding of confirmed banned accounts for the above reasons: This will result in an immediate and irrevocable restriction.
  

•   Minting identical OBJKTs on other platforms without making clear reference to prospective buyers, including cross-chain. This will result in restriction and may be upheld or reversed following review.
  

Copyminting can also include OBJKTs that are based on another artist(s) work, with minimal filters or modifications applied, including where the original artist(s) have stated an objection directly to hicetnunc.xyz and/or publicly.

Contesting those restrictions can also be made through Discord and E-mail. It’s important to notice that accidents/human errors are possible and we apologize for such cases. We ask users to direct such issues exclusively through the channel.

Due the fact that hicetnunc.xyz is a decentralized application, restricted OBJKTs are only superficially restricted meaning that they are still available through our APIs, and through on-chain data. Tools which allow accessing them without restriction nonetheless should be further developed to guarantee the liberty of users and for them to not be dependent exclusively on https://hicetnunc.xyz/.

This code is intended as a framework of ethics for creators to foster a healthy long term relationship and trust with collectors. It is not intended to be enforced by anyone or to be used in any binding capacity.

• I will not mint anyone else’s work without their prior knowledge and agreement

• If a work is the result of a cooperation I will give credit where credit is due

• I will not mint the same work on different chains or platforms unless explicitly stated beforehand

• I will not re-mint any of my work unless it is in a transformative way

• If an NFT is part of a series of similar works I will declare this from the first minted work

• I will not mint any work that infringes on the personal rights of other individuals (Parody and satire are not regarded as an infringement of personal rights.)

• If possible I will contact the author of a work that I wish to create a derivative work of

• I will not try to misrepresent the identity of the author of the work or the identity of the work that I mint

• I may sell physical editions with the same content as my NFTs unless I specifically tie a physical edition to a tokenized one and vice versa

• I will be transparent about any future potential technical issues with the preservation and longevity of my NFT to the best of my knowledge.
